BREAKING DOWN THE TITLE IX CHANGES: The Biden administration has changed Title IX, the law best known for ensuring young women equal access and treatment in education and athletic programs. Their change redefined “sex” within its statutory protections to include “sexual orientation and gender identity,” and through that, the Department of Education is opening the door for males who claim to identify as females to gain access more easily to women’s sports, locker rooms, bathrooms, and opportunities.

Once the Title IX rule change takes effect, families who oppose gender ideology, enabling biological males to claim coveted female athletic scholarships, compete in women’s sports, and shower amongst female teammates, will have little recourse. Fortunately, federal district court judges put a temporary hold on Biden’s Title IX changes, ruling that the original intent of Title IX did not include gender identity. The concern surrounding males competing in and taking advantage of opportunities intended for girls is not unfounded. In fact, five West Virginia middle school girls were recently banned from participating in all future track and field meets for protesting a biological male’s participation in their sport. This occurred despite an existing West Virginia law that bans biological males from playing on girls’ sports teams.

In Washington State, female athletes saw a biological male take first place in a Junior Olympics Track event:

STATES SAY ‘NO THANKS’: In response to the rule change, more than a dozen states have filed lawsuits in federal courts arguing that the Biden administration is severely distorting the original intent of Title IX and does not have the authority to implement such sweeping rule changes. As Virginia Attorney General Jason Miyares said recently:

“The Biden administration’s unlawful rule would jeopardize half a century of landmark protections for women, forcing the administration’s social agenda onto the states by holding federal funding hostage.”

States currently involved in litigation against the Title IX regulatory changes include Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia and Wyoming.
